Article 1 – Identity and Applicability
1.1 These general terms and conditions apply to offers, orders, agreements, and deliveries by
GUNPOWD3R.
1.2 GUNPOWD3R is the trade name of Orangebaum, a sole proprietorship.
1.3 Registered address: De Windturbine 7, 3815 KP Amersfoort, Netherlands.
1.4 Chamber of Commerce: 92400035. VAT identification number: NL004952643B17.
1.5 These terms and conditions will be made available before or at the latest upon entering into the
agreement so that the consumer can save them.
Article 2 – Offer
2.1 Product information, prices, and any shipping costs are clearly stated with the offer.
2.2 Obvious mistakes and clear pricing errors do not bind GUNPOWD3R.
2.3 Images and product specifications are intended to represent the product as accurately as possible.
Article 3 – Agreement
3.1 The agreement is concluded when the order has been placed according to the ordering process and
confirmed by GUNPOWD3R.
3.2 The consumer will receive an electronic order confirmation.
3.3 If an order cannot be fulfilled, the consumer will be informed as soon as possible, and any amounts
already paid will be refunded.
Article 4 – Prices
4.1 Consumer prices are stated in euros and include VAT.
4.2 Any shipping costs will be clearly displayed before the order is finalized.
4.3 For orders from €25 within the offered shipping areas, free standard shipping applies, unless stated
otherwise in the offer.
4.4 Price changes apply only to future orders.
Article 5 – Payment
5.1 Available payment methods will be listed during the ordering process.
5.2 The order must be paid according to the chosen payment method.
5.3 Post-payment is only possible if agreed upon in advance.
Article 6 – Right of Withdrawal
6.1 The consumer generally has a 14-day statutory cooling-off period for online purchases.
6.2 The complete regulation is stated in the Return and Refund Policy.
6.3 Statutory exceptions to the right of withdrawal remain applicable.
6.4 The consumer retains all legal rights in case of non-conformity and statutory warranty.
Article 7 – Delivery
7.1 Orders placed on weekdays before 4:00 PM are aimed to be processed on the same business day.
7.2 Delivery within the Netherlands generally takes place on the next business day.
7.3 Different delivery times may apply for Belgium and Germany.
7.4 Stated delivery times are indicative, unless a statutory or expressly agreed ultimate delivery period
applies.
7.5 The risk of a consumer purchase transfers to the consumer as soon as they or a third party designated
by them has received the product, unless the law stipulates otherwise.
Article 8 – Conformity and Complaints
8.1 Products must conform to the agreement.
8.2 Complaints about damaged, incorrect, or defective products can be reported as soon as possible via
info@gunpowd3r.com.
8.3 Statutory warranty and statutory conformity rights are not excluded.
8.4 Product information, warnings, and instructions for use must be followed.
Article 9 – Food Supplements
9.1 Food supplements are not a substitute for a varied diet and healthy lifestyle.
9.2 Products are not intended for the diagnosis, treatment, or cure of diseases.
9.3 In case of doubt about use, medication use, pregnancy, or a medical condition, it is advised to consult a
doctor or authorized healthcare professional.
Article 10 – Liability
10.1 Nothing in these terms and conditions limits liability insofar as such a limitation is not legally
permitted.
10.2 GUNPOWD3R is not liable for damage arising from use contrary to product information or instructions
for use, to the extent legally permitted.
10.3 Statutory consumer rights remain fully in force.
Article 11 – Force Majeure
11.1 Force majeure means a circumstance beyond GUNPOWD3R's reasonable control that temporarily
makes performance impossible.
11.2 This may include serious disruptions at suppliers or carriers, internet or payment disruptions,
government measures, natural disasters, strikes, and cyber incidents.
11.3 This provision does not limit statutory consumer rights.
Article 12 – Intellectual Property
12.1 Texts, images, logos, and other content of GUNPOWD3R may be protected by intellectual property
rights.
12.2 Copying or commercial use without permission is not allowed, except where permitted by law.
Article 13 – Reviews
13.1 Reviews must be based on an actual experience.
13.2 GUNPOWD3R may remove reviews if they are, for example, unlawful, discriminatory, threatening,
spam-like, or misleading, contain personal data of third parties, or infringe on the rights of third parties.
13.3 Reviews will not be removed solely because they are negative.
Article 14 – Applicable Law and Disputes
14.1 Agreements are governed by Dutch law, unless mandatory law of the country where the consumer
resides stipulates otherwise.
14.2 Consumers retain the rights and competent court they have based on applicable mandatory consumer
law.
